These Terms & Conditions ("Terms") govern your access to and use of the website operated by Pharmique Pharmacy ("Pharmique," "we," "us," or "our"), located at 1210 S International Pkwy Ste 166, Lake Mary, FL 32746, and any services, content, forms, or features made available through it (collectively, the "Site").
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy and Medical & Legal Disclaimer, which are incorporated herein by reference. If you do not agree to these Terms, please do not use the Site.
2. Eligibility
You must be at least 18 years of age, or the age of majority in your state of residence, to use this Site. By using the Site, you represent and warrant that you meet this requirement and that the information you provide is accurate, current, and complete. The Site is intended for users located in the United States, and primarily for residents of the State of Florida and areas where Pharmique is licensed to provide pharmacy services.
3. Nature of the Site and Services
This Site provides general information about Pharmique Pharmacy and its compounding and pharmacy services, and allows you to submit prescription refill requests, prescription transfer requests, and general inquiries through online forms.
- No online sales or payment processing. The Site does not sell medications or process payments online. Submitting a form does not constitute a purchase, an order confirmation, or a guarantee that a prescription can or will be filled.
- Requests are not prescriptions. All prescriptions require a valid order from a licensed healthcare provider and are subject to verification, pharmacist review, and applicable law.
- No professional relationship by form. Submitting a request or using the Site does not, by itself, create a pharmacist-patient or doctor-patient relationship.
4. No Medical Advice
The content on this Site is provided for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Compounded medications are not FDA-approved. Always consult your physician, pharmacist, or other qualified healthcare provider regarding any medical condition or treatment.

5. Acceptable Use
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree that you will not:
- Provide false, misleading, or fraudulent information, including impersonating another person or submitting a prescription request on behalf of someone without authorization;
- Attempt to obtain medications without a valid prescription or in violation of state or federal law;
- Use the Site in any way that violates applicable laws or regulations, including HIPAA, DEA, FDA, and Florida Board of Pharmacy rules;
- Introduce viruses, malware, or other harmful code, or attempt to gain unauthorized access to the Site, its servers, or any connected systems;
- Interfere with or disrupt the Site, including through automated scraping, denial-of-service attempts, or excessive automated requests;
- Reproduce, distribute, or create derivative works from Site content without our prior written permission.
6. Your Submissions and Communications
When you submit information through our forms, live chat, or other Site features, you are responsible for the accuracy of that information. Please do not transmit sensitive Protected Health Information (PHI) through web forms or live chat; for prescription matters, contact us directly at (407) 610-9090.
By submitting non-confidential feedback, suggestions, or ideas about the Site or our services, you grant us a non-exclusive, royalty-free, perpetual right to use them without obligation or compensation to you. We handle your personal and health information as described in our Privacy Policy.
7. Intellectual Property
All content on the Site, including text, graphics, logos, images, page layouts, and the "Pharmique" name and branding, is owned by or licensed to Pharmique Pharmacy and is protected by United States and international copyright, trademark, and other intellectual property laws. You are granted a limited, revocable, non-exclusive license to access and use the Site for your personal, non-commercial use. No other rights are granted, and any unauthorized use is prohibited.
8. Third-Party Links and Services
The Site may contain links to, or integrate, third-party websites and services (for example, our live chat provider). We do not control and are not responsible for the content, accuracy, availability, or privacy practices of third parties. Your use of third-party websites and services is governed by their own terms and policies and is at your own risk.
9. Disclaimer of Warranties
The Site is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Pharmique disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that the information on the Site is accurate, complete, or current.
10. Limitation of Liability
To the fullest extent permitted by law, Pharmique Pharmacy and its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your access to or use of (or inability to use) the Site, even if advised of the possibility of such damages.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability relating to the professional pharmacy services we provide, which are governed by applicable Florida and federal law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Pharmique Pharmacy and its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
12. Binding Arbitration & Class Action Waiver
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
12.1 Agreement to Arbitrate
Except as set out below, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall be conducted in or near Seminole County, Florida, and judgment on the award may be entered in any court of competent jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.
12.2 Class Action Waiver
You and Pharmique agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.
12.3 Exceptions
Notwithstanding the above, either party may (a) bring an individual claim in small-claims court where jurisdictional requirements are met, and (b) seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information. This Section does not apply to any claim that, by law, may not be subject to arbitration, and does not limit any rights or remedies available to you under the professional and regulatory standards governing licensed pharmacies.
12.4 Opt-Out
You may opt out of this arbitration agreement by sending written notice to legal@pharmique.net within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
13. Governing Law & Venue
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles. Subject to the arbitration provisions in Section 12, you agree that any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Seminole County, Florida, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and post the updated Terms on this page. Material changes may be communicated through additional notice where appropriate. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.
15. Termination
We may suspend or terminate your access to the Site at any time, without notice, for any reason, including if we believe you have violated these Terms. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will continue to apply.
16. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Pharmique regarding the Site.
- Severability: If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment: You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
